Payment Incidents Register


Summary

The Payment Incidents Register (PIR) is a system that collects, stores and compiles information on payment incidents involving cheques, bills of exchange and promissory notes caused by account holders.

Information to PIR is conveyed electronically through the Interbank Communication Network.

The PIR database comprises two files:

  1. Payment Incidents National File (PINF) with three components:
    • Cheques National File (CNF),
    • Bills of Exchange National File (BNF),
    • Promissory Notes National File (PNNF)
  2. Risky Persons National File (RPNF) automatically fed from PINF.

The Risky Persons National File (RPNF) collects information on major payment incidents registered on the name of an account holder.

Payment incidents can be erased from the database only if cancelled by the same reporting institution which has previously submitted the mentioned information to the PIR on its own initiative or based on an enforceable court decision.

The suspension of cheque-writing privileges is imposed by a drawee bank on an account holder. The latter is forbidden to issue cheques forms for one year following a major payment incident involving a cheque. Thus, further payment incidents are avoided.

The lift/resumption of the suspension of cheque-writing privileges involving a cheque, as well as the suspension/reactivation of the registration of minor payment incidents involving cheques and of the registration of payment incidents of bills of exchange and promissory notes may be made, based on an enforceable court decision, only by the reporting institution who previously submitted the information regarding payment incidents to the PIR, in accordance with the provisions of Articles 11 and 12 of the NBR Regulation no.7/2023.

Based on the information received from the reporting institutions, the PIR will send electronically to all reporting institutions the "PIR Notification form for the suspension of cheque-writing privileges/for payment incidents" and the "PIR Notification form for the lift/resumption of the suspension of cheque-writing privileges/the suspension/reactivation of the registration of payment incidents"

The reporting institutions shall disseminate the information in their own intrabank system.

In case of a major payment incident involving a cheque, the credit institution where the payer has opened an account shall take the necessary measures to recover as soon as possible all cheque forms issued to them.

The users of the information in the PIR database are:

  1. the National Bank of Romania;
  2. the reporting institutions.
